 Terms and Conditions for AKER MEDIA Photography

 1. Booking Fees

When booking a session with AKER MEDIA, the client agrees to a non-refundable booking fee. This fee is used to cover the service of determining availability, adding the session to our internal calendar, and sending confirmation communications (via text message and/or email). This fee secures the photographer's time and administrative efforts and does not apply toward any final product or image delivery.

2. Rescheduling and Cancellation

If the client needs to reschedule a session, AKER MEDIA

will make every reasonable effort to accommodate the change. However, rescheduling will require payment of an additional booking fee. The original booking fee remains non-refundable, even if the session is rescheduled.

Cancellations result in forfeiture of the booking fee, and no refunds will be issued.

3. Photo Licensing

AKER MEDIA grants clients a limited, non-transferable license to use the photos from their session for personal purposes only. This includes sharing, distributing, and circulating the images on social media, in print, or with family and friends for **non-commercial purposes.

However, the following restrictions apply:
- Photos may not be sold or resold to any third party.
- Photos may not be used by another individual or entity engaged in any form of commercial activity without the express written authorization of AKER MEDIA

Failure to adhere to these licensing terms may result in legal action or revocation of usage rights.

4. Right to Use by AKER MEDIA

By booking a photography session, the client acknowledges and agrees that AKER MEDIA has the right to use the photos or videos produced during the session for commercial purposes. These include, but are not limited to:
- Promoting AKER MEDIA's services on websites, social media, advertisements, and other marketing materials.
- Displaying images in AKER MEDIA's portfolio for potential clients or promotional purposes.

AKER MEDIA reserves the right to publish or distribute these images without additional client approval, although privacy and personal identity will be considered when appropriate.

5. Text Message Communication & A2P Compliance

By providing your contact information and agreeing to receive communications, you consent to receive text messages (SMS/MMS) and emails from AKER MEDIA. These messages may include, but are not limited to, appointment confirmations, scheduling information, promotional offers, and updates.

Opt-In: You will only receive text messages if you have explicitly opted in. This may occur through booking a service, signing up via a form, or another clear action where you have agreed to receive SMS communications.

Opt-Out: At any time, you can opt out of receiving text messages by replying with “STOP” to any text message. By opting out, you understand that you may not receive essential communication regarding your appointments or promotions. If you wish to opt back in, you may reply with "START" or contact us directly.

We comply with all A2P (Application-to-Person) messaging regulations, including those set forth by the **Telephone Consumer Protection Act (TCPA) and CTIA standards. We will not share or sell your personal information and will only use it in accordance with these Terms and Services.

6. Delivery of Photos

Final edited photos will be delivered to the client within time stated in booking confirmation. AKER MEDIA will provide digital files via a secure link or other agreed-upon methods. Unedited or RAW files will not be released unless otherwise agreed upon in writing.

7. Limitation of Liability

While AKER MEDIA takes all necessary precautions to deliver high-quality images, we are not liable for circumstances beyond our control (e.g., weather conditions, acts of God, or other unforeseen events) that might affect the outcome of the photography session.

 8. Governing Law

These Terms and Services are governed by the laws of the State of [insert your state], and any legal disputes will be handled in courts located within [insert your city/county].

9. Agreement to Terms

By booking a photography session with AKER MEDIA, the client agrees to all the terms and conditions outlined above.
